Do I need a licence to rent out my property?
It depends on the property and the council area. Mandatory HMO licensing applies across England and Wales to larger HMOs (5 or more occupants forming 2 or more households). Many councils also run additional licensing (smaller HMOs) or selective licensing (all private rented homes) in designated wards. What are the penalties for an unlicensed property?
Councils can issue civil penalties of up to £40,000 per offence for offences committed on or after 1 May 2026 under the Renters’ Rights Act (previously £30,000), prosecute with unlimited fines, and tenants can reclaim up to 24 months’ rent through a rent repayment order.
