Kamma Website Terms of Use

1. About these terms and who we are

1.1 These terms of use (Terms) apply to your use of www.kammadata.com and www.kammaclimate.com and their pages, tools and content (each a Website). References to the Website mean whichever of these sites you are using. By using the Website you agree to these Terms. If you do not agree, please do not use the Website.
1.2 The Website is operated by Kamma Limited (Kamma, we, us, our), a company registered in England and Wales under company number 09546202, with its registered office at Unit 207, Elementa Workspace, 1 Giltspur Street, London EC1A 9DD. Our VAT number is 262893571.
1.3 You can contact us at support@kammadata.com or through our contact page.
1.4 In these Terms, you means the person using the Website. If you use the Website on behalf of a business or other organisation, you confirm you have authority to accept these Terms on its behalf.
1.5 We recommend you print or save a copy of these Terms for future reference.

2. Our products and other terms that apply

2.1 These Terms cover the Website only. Our paid and account-based services (the Services) have their own terms. These Services include Kamma Suite, Kamma Applications and Kamma Quick Check, and our climate products: property-level climate data and reporting and Retrofit Explorer. They are governed by our Subscriber Terms at www.kammadata.com/support/subscribers and the documents referred to in them. If there is a conflict between these Terms and the Subscriber Terms in relation to the Services, the Subscriber Terms take priority.
2.2 Signing in at suite.kammadata.com takes you to the Services, not the Website.
2.3 These additional documents also apply to your use of the Website:
- (a) our Website Privacy and Cookie Policy at www.kammadata.com/support/privacy/, which explains how we use personal information collected through the Website and how we use cookies; and
- (b) any specific terms shown alongside a particular tool or feature on the Website (for example, a free licensing check), which apply in addition to these Terms.

3. Information on the Website and free licensing tools

3.1 Content on the Website, including our property licensing guides, news, and results from the Property Licence Checker, our climate and retrofit insights, or any other free tool (Free Tools), is provided for general information only. It is not legal, financial or professional advice, and you should not rely on it as such.
3.2 Licensing schemes are created, changed, renewed and ended by local authorities, often at short notice. Free Tool results are based on information available to us at the time, which may be incomplete, out of date or wrong. A result does not confirm whether a property needs a licence or is licensed.
3.3 Climate risk, emissions, energy efficiency, retrofit cost, bill saving and grant information on the Website is based on modelled data and general assumptions. It may not reflect the condition of a particular property. Grant eligibility is decided by the scheme administrator, and funding schemes can change or close at short notice.
3.4 Before you let, buy, sell, manage, finance, invest in or upgrade a property, or rely on Website content for regulatory or investor reporting, you should check the position with the relevant local authority or scheme administrator. You should also take professional advice where appropriate.
3.5 We do our best to keep the Website accurate and up to date, but we do not promise that its content is complete, accurate or current.
3.6 If you give us your email address to receive a Free Tool report, we will use it as described in our Website Privacy and Cookie Policy.

4. Acceptable use

4.1 You may use the Website for lawful purposes only. You must not:
- (a) use the Website in any way that breaches any applicable law or regulation, or that is fraudulent or harmful;
- (b) use any robot, spider, scraper or other automated means to access, copy, extract or monitor the Website or Free Tool results, or run Free Tool queries in bulk, without our prior written consent;
- (c) use the Website or its content to build or improve a competing product or service, or to compile a database;
- (d) use Website content to train, fine-tune or test any artificial intelligence or machine learning model without our prior written consent;
- (e) attempt to gain unauthorised access to the Website, the server it is stored on or any connected system, or interfere with its operation (including by introducing viruses or other harmful material, or by a denial-of-service attack);
- (f) submit false information, or information about another person that you do not have the right to share, through any form on the Website; or
- (g) send unsolicited advertising or promotional material through the Website.
4.2 We may suspend or restrict your access to the Website or any Free Tool if we reasonably believe you have breached this section. Some of these actions may also be criminal offences, for example under the Computer Misuse Act 1990, and we may report them to the relevant authorities.

5. Intellectual property

5.1 We, or our licensors, own all intellectual property rights in the Website and its content, including text, guides, data compilations, Free Tool results, software, design, layout, graphics and logos. These rights are protected by copyright, database right and other laws around the world.
5.2 You may view the Website, print or download extracts of individual pages, and share links to it, for your own reference or for use within your organisation. You must not modify any material you print or download, and you must keep our status (and that of any identified contributors) as authors of the content.
5.3 You must not use any part of the Website content for commercial purposes, or republish, sell or redistribute it, without a licence from us. To ask about licensing our data, contact support@kammadata.com.
5.4 "Kamma", "Kamma Climate", "Retrofit Explorer" and our logos are our trade marks. Other names, logos and trade marks shown on the Website, including those of our customers, partners and integration providers, belong to their owners. They are used with permission or for identification only, and their display does not imply any endorsement unless we say so.

6. Availability, links and security

6.1 The Website and Free Tools are provided free of charge. We do not guarantee that they will always be available or uninterrupted. We may suspend, withdraw or change any part of the Website for business or operational reasons, and will try to give reasonable notice where we can.
6.2 The Website may link to websites and resources provided by others, including local authorities, grant schemes, installers and our partners. These links are for your information only. We have no control over those sites and are not responsible for their content or for any loss that may arise from your use of them.
6.3 You may link to the Website's home page, provided you do so fairly and lawfully and do not suggest any form of association, approval or endorsement on our part where none exists. We may withdraw this permission at any time.
6.4 We take reasonable steps to keep the Website secure, but we do not guarantee that it will be free from bugs or viruses. You should use your own virus protection software.

7. Our liability

7.1 Nothing in these Terms excludes or limits our liability for death or personal injury caused by our negligence, for fraud or fraudulent misrepresentation, or for any other liability that cannot be excluded or limited under the law of England and Wales.
7.2 If you are a business user:
- (a) we exclude all implied conditions, warranties, representations or other terms that may apply to the Website or its content;
- (b) we will not be liable to you for any loss or damage, whether in contract, tort (including negligence), breach of statutory duty or otherwise, arising under or in connection with your use of, or inability to use, the Website, or your use of or reliance on any content on it, including Free Tool results;
- (c) in particular, we will not be liable for loss of profits, sales, business or revenue; business interruption; loss of anticipated savings; loss of business opportunity, goodwill or reputation; fines, penalties or enforcement costs imposed by a local authority or regulator; the cost of property works; or any indirect or consequential loss or damage; and
- (d) if, despite the above, we are found liable to you, our total liability arising out of or in connection with the Website will not exceed £100.
7.3 If you are a consumer:
- (a) we provide the Website for your own personal use, and not for resale or redistribution, and are not liable to you for any loss of profit, loss of business, business interruption or loss of business opportunity;
- (b) if we fail to comply with these Terms, we are responsible for loss or damage you suffer that is a foreseeable result of our breach or our failure to use reasonable care and skill, but we are not responsible for any loss or damage that is not foreseeable; and
- (c) nothing in these Terms affects your statutory rights.
7.4 Use of the Services is governed by the limitation of liability in the Subscriber Terms, not this section.

8. General

8.1 Privacy and cookies. We use personal information collected through the Website in line with our Website Privacy and Cookie Policy. You can change your cookie choices at any time through the cookie settings link on the Website.
8.2 Changes to these Terms. We may update these Terms from time to time, for example to reflect changes in law or to the Website. The updated Terms will apply from the date they are published on this page, which is shown at the top. Please check this page each time you use the Website.
8.3 Severability. If a court or other competent authority finds any part of these Terms invalid or unenforceable, the rest will continue in force.
8.4 No waiver. If we delay or do not enforce any of these Terms, we can still enforce them later.
8.5 Third-party rights. No one other than you and us has any right to enforce these Terms.
8.6 Governing law and jurisdiction. These Terms, and any dispute or claim (including non-contractual disputes or claims) arising out of or in connection with them or the Website, are governed by the law of England and Wales.
- (a) If you are a business, the courts of England and Wales have exclusive jurisdiction.
- (b) If you are a consumer, you may bring proceedings in the courts of England and Wales, or, if you live in Scotland or Northern Ireland, in the courts of that country.
